TYPES OF WORK PERMIT VISA

There are two types of work permits given by Canadian authorities- open work permit and an employer specific work permit.

The Canadian government gives out two different kinds of work permits: an open work permit and a work permit that is specific to an employer. With an open work permit, you can basically work for any company.This visa is not tied to a specific job, so applicants do not need the Labor Market Impact Assessment (LMIA) or an offer letter from an employer who has paid the compliance fee.

With an open work permit, you can work for any Canadian employer except those that don’t follow labour laws or offer services like escort services, erotic massage, or exotic dancing.

As the name suggests, an employer-specific work permit lets you work for a specific employer. The employer-specific work permit can only be used with one employer.

HOW THE WORK PERMIT WORKS

The employer-specific work permit is only good for one employer. The open work permit, on the other hand, can have certain conditions written on it. This includes:

  • Kind of job
  • Places where you can get a job
  • Work Duration

JOB POSITIONS THAT DON’T NEED A WORK PERMIT

There are some jobs that don’t need a work permit. Here is a list of those jobs:

  • Student with a job on campus
  • Athlete or coach
  • Reporter for the news or a film and media crew
  • Artist who does shows
  • Investigator and judge
  • Aviation accident or incident investigator
  • Business visitor
  • Inspector of civil aviation
  • Clergy
  • Organizer of a convention

  • A judge, referee, or other type of official

  • An expert witness or a detective
  • Military personnel
  • Talker in public
  • Short-term worker with a lot of skills
  • Student who works away from campus

  • Member of the family of a foreign official

  • A person or group from a foreign government
  • Student who works away from campus
  • Student with a job on campus
  • A student in health care

ELIGIBILITY TO GET A WORK PERMIT FROM OUTSIDE OF CANADA

No matter what kind of work permit you want, you have to meet certain requirements to be eligible. These are:

  • Show the immigration officer proof that you will leave Canada when your work permit runs out.
  • Proof that you and your family have enough money to stay in Canada while your work permit is valid.
  • Proof that you have never been in trouble with the law
  • Proof that you are healthy and willing to get checked out by a doctor.
  • Must show that you are not a threat to society in Canada.
  • Being willing to follow the rules of your work permit
  • To prove you can enter Canada, you must meet certain requirements, such as being able to speak the language, having biometric data, and having insurance

ELIGIBILITY TO GET A WORK PERMIT FROM INTSIDE OF CANADA

You have to meet certain requirements before you can apply for a work permit from inside Canada. These includes:

  • Having a valid study permit
  • Your spouse, common-law partner, or parents have a work or study permit.
  • You finished a course at a Canadian University.
  • You have a temporary residence permit that lets you stay in the country for six months.
  • You applied for PR from inside Canada and are waiting to hear back.
  • You have applied for refugee status or plan to do so.
  • The IRCC has decided that you are a refugee.
  • Under NAFTA, you are a trader, an investor, part of an intra-company transfer, or a professional.
DEPENDENT WORK VISA

The Canadian government lets family members come to live there with a dependent work permit.

If you get a job offer from a Canadian company and have an open work permit, your spouse and children may be able to join you in Canada.

Your kids will be able to go to schools in Canada without needing to get separate study permits. Your spouse will also be able to apply for an open work permit so they can work in Canada. Some family members, like a spouse or children, can apply for a dependent visa to Canada. Parents and grandparents, on the other hand, must be sponsored by a permanent resident or a Canadian citizen.

To make sure the family member or relative is well-settled in Canada, the sponsor must promise to take care of them and be with them for 3 to 10 years.

POST GRADUATE WORK PERMIT (PGWP)

 The Post Graduate Work Permit (PGWP) was made so that international students with a certificate, diploma, or degree from a Canadian Designated Learning Institution (DLI) and a tertiary qualification can live and work in Canada for up to three years. The PGWP work permit takes between 80 and 180 days to process, so it’s important to apply early.

As an international PGWP student in Canada, you can apply for an open work permit. This lets you work for any employer in Canada and get the work experience you need to apply for permanent residency.

If you can only work for one company, like a construction worker, an employer-specific work permit is the best choice because you can only work for one company and in one province.

INTERNATIONAL EXPERIENCE CANADA (IEC)

Through International Experience Canada (IEC), young people can work and travel around Canada at the same time. This programme has three different parts:

  • Young Professionals
  • International Co-op (Internship)
  • Working Holiday

The working holiday visa is the most popular. The working vacation visa is perfect for people who want to see Canada and make money at the same time. Depending on how long you stay in your home country, it is good for 12 to 24 months. You can only get this permit if you are from one of the 35 countries that Canada has a youth mobility agreement with.

TEMPORARY FOREIGN WORKER PROGRAM

This programme helps a lot of Canadian businesses that need to fill jobs that can’t be done by Canadian citizens or permanent residents. When a Canadian company hires a foreigner, they get new skills and knowledge that wouldn’t have been available in Canada. This is why most jobs require the company to get an LMIA.

THE STREAM OF GLOBAL TALENT (GTS)

The Global Talent Stream (GTS) is a government programme that aims to speed up the application process for both Canadian companies and foreign workers. The time it takes to process a Canada work permit for this stream is less than two weeks. Through the Global Talent Stream, people who have a job offer in Canada and are applying from outside of Canada and meet the requirements in any of the categories below can do so. This lets Canadian companies hire highly skilled foreign workers for short-term jobs in one of two ways:

CATEGORY 1

This category is for employers who have been recommended by one of GTS’s 45 certified partners and are looking for unique and specialised foreign talent.

Category 2

Employers who want to fill jobs in Canada with highly skilled foreign workers whose jobs are on the Global Talent Occupations List should use this category.

HOME SUPPORT PILOT

When neither Canadians nor permanent residents are available, the Home Support Pilot lets Canadian families hire foreign nationals who can care for seniors, children, or people with disabilities in their own homes. Employers can ask for carers to live with them. There are two types of in-home carers: those who help people with serious medical needs and those who help children.
